State

The state court system in North Carolina is divided into three parts in each county: Magistrate, District and Superior Court. Which court hears a case depends on the severity of the charge or claim. Magistrates hear small claims not exceeding $5,000 and minor criminal matters. District Court cases range from traffic infractions to low-level felonies. The court also handles child support, custody matters and civil cases up to $10,000. Superior Court judges handle major felonies, civil cases seeking more than $10,000 and criminal case appeals from District Court.
